Bail FAQ

What is bail?

Bail is a property deposit that someone deposits or pledges to the court in return for being released from jail with the promise of returning for the trial. It is understood that the bail money is forfeit if the individual does not appear.

What is a bail bondsman?

A bail bondsman can either be a person or corporation that provides the bail money for a defendant who cannot afford it themselves. When the trial is concluded, the bail bondsman has the bail money returned. For providing this service, they collect a premium on the money or property that they have provided. Bail bondsmen sometimes help to enforce the defendant’s appearance in court since their money or property is at stake.

What does it mean to be released ROR?

Being released ROR means that they defendant is released on their own recognizance and only needs to sign an agreement saying that they will appear for their arraignment or trial. This is usually done instead of bail for minor crimes, in which it is unlikely that the defendant would avoid returning.
